Question

Court Issued Restriced License Help


What is the name of your state? CA

I asked this question before but didn't receive an answer. Along with an order to attend a First offense DUI Program, My driver's license restricted to drive to work and to my program for 90 days. Before this the DMV had suspended my license for One year. Do I have the right to drive to work and to my program based on the court's decision for me to have a restricted license, or do I still have to apply for a restricted license through the DMV?

If the DMV suspended your license you must go to the DMV to secure whatever license you need or can get. The court may limit your license (restrict or suspend) on their order but the DMV is actually a seperate entity and the fact that the court may state you can have a restricited license does not require the DMV to issue one.
In other words: the court can add their own restrictions on your license but that does not override the DMV status. So the most restrictive of the two is what you end up with.

The DMV and the court work separately as the previous poster stated. If you get your license suspended from the DMV there is a 4 month suspension.... after that you may be able to petition for a restricted license to and from work and school(i believe). WHen you finally get to court (it took them like 2 months for me) they will suspend your license AGAIN but this time its a court suspension so if you look at it that way your going to get your license back on the same day as your court date.. just a year later. If you know forsure your going to lose your license (meaning you have no offense) try to get into the cout as soon as possible.

oh yeah if this is taylor ask dan for my SN or whatever.

Also depending on how the judge is feeling/ and the severity of your DUI, they will offer you differance. It is basically 8 AA meetings and it will be dismissed from your record. Dont get your hopes up. Dismissed means that it will say you were convicted but charges were dismissed (well thats what a lady at the court told me... im not sure i dont know how to find my criminal record). As for your license, according to a post on your other thread, one of the guys said anyone cited after sept 20 2005 must go a whole year without a license of ANY kind. No restricted either.
