What is the name of your state (only U.S. law)? NY

As a driver, no open alcohol can be in the car correct?

If the passengers were all drunk can one get in trouble if they were a designated driver, not drinking?

This didn't happen, part of a conversation that came up.

Driving intoxicated people (provided no open containers) isn't illegal. However, if you get stopped, the fact that your friends are stinko drunk can cause problems for you if they can't control themselves.
