Question

Do they have a case?


What is the name of your state? ND
Hi i'm 17 and from Fargo North Dakota with a few questions.
I wondering if i could be convicted with a DUI if i was not given some time of citation like a ticket perhaps. On the night of this acurance I was told by the officer that i would be let off without anything. however, 3 weeks later i recived a summins to court for DUI.. so my question is..does prosecution have a case without some type of citation or signed document?

The summons is all that is required. You should see an attorney as soon as possible.

another thing that bothers me is the actuall pull over.. what happend was i walked out of a party after drinking one beer and went to my car.. i then started it and moved no more then 5 feet to see a patrol car blocking my passage. he then turned on his lights and aproched my car.. I don't know much about my rights and all but is that a legal stop.. i mean.. what is the probable cause? please help thanks

**A: instead of going to parties and taking part in illegal underage drinking, you should be at home studying your spelling and grammar.

Don't pay any attention to HOMEguru. you see by the name it is, LIFE LESS, spends its time here insulting people, calls the insults advice. You need to ask a lawyer about the legality of the stop. Most states if the key is in the ignition you can be cited for DUI, even if the car is not running. Sounds like the cop staked out the party and waited for a pigeon, you happen to be it. The not giving you something on paper to me is very questionable, I myself had 3 dui's as a teen and always got some kind of paperwork. Talk to a lawyer, look one up in the phonebook, many will talk to you a free the first visit. Ask the lawyer if you should start attending AA before court. You may not have a alcohol problem, but most states now require 6-12 months of AA, when you get a dui.

Sometimes people need to be put in their place. Coddling them and condoning their attempts to weasal out of the consequences of their actions is a detriment to our society. No wonder the world is so screwed up. People rarely have to accept any responsibility for their actions. They don't even have to accept scorn from their peers. After all, we wouldn't want to hurt their feelings!!!

Additionally, anyone who commits a crime and then whines on the net deserves to be called an idiot.

Based solely upon the facts presented, the stop sounds illegal. Chances are that there was more to it than our friend the underage drunk lets on. Simply leaving the party isn't PC.

We don't give paper for a DUI. You'll get the summons in the mail.

Oh, and Raymas buddy......I don't know if I would take advice from someone with "3 dui's as a teen". Seems like someone with trouble learning.

Bra, there is a difference between teaching and DELIBERATELY hurting people. If you were ever my teacher I would definatley keep a gun in the hand just to protect myself from your viciousness. I have read a lot of your posts, I mean a lot. You insult people more then you advise them. If you are a cop, your quote tells me you'd rather people shoot each other, GOD forbid they should disturb perfect you! As a cop, that is your job policing, no where does that job description say, JUDGE, JURY and EXECUTIONER. I see alot of hostility in your posts, and have to wonder if you may be the next cop who goes postal. Your Rage is not against a machine, it is against a system. There is where your hostility should be directed, maybe the department shrink can help you. Not everyone that writes in this forum is looking for a easy way out. Some of us know where and how we screwed up, and are looking for advice to make ammends the right way. I am one of those. Regardless of the bs I wrote in regards to Gov. Ryan, I am going thru proper channels to get my license straight. If you have never been on the receiving end of a dui you are no more qualified then I am to give advice on the subject. Considering you are only a giver of dui's the people here seeking advice really dont want to hear from you anyway. Remember YOU HAVE THE RIGHT TO REMAIN SILENT. I have no clue as to what you are talking about. Who is Gov. Ryan? According to Jazz's post above, I guess it has something to do with your being pardoned**************.

But that's really immaterial......and you misinterprete my posts.

First of all, I highly doubt you have "read a lot of your posts, I mean a lot." When I look at my measly 100+ posts compared to post counts in the 5000+ category, I cna't help but think you are feeding me a line of bull****.

I do not come here to teach. I come here to discuss legal issues, offer my opinion on various legal issues, and to tell people not to be an idiot if need be. Unfortunately you don't understand that sometimes people need to be told**************.that's part of teaching too.

You are correct that many people here are looking to make things right. Many are also here looking for that loophole so they can skirt their responsibility. Those are the people I won't help. Post a legitimate question, get a legitimate answer. It's pretty simple.

I don't give DUI's. You drank, you drove. You gave yourself a DUI. I can see from these types of comments that you advocate blaming everyone else for your problems. Try taking responsibility for your actions....maybe you'll get more respect around here.

BTW, my signature means that the means to protect oneself is better than relying on others who may not be able to. It is an anti-gun control quote, stating I support the rights of private citizens to arm themselves for self-defense. The police cannot be everywhere.

I don't know about you, but when that crazed murderer is breaking through my door, I'd prefer a gun in my hand rather than a phone.

You misinterpretation and deliberate perversion of my sentiment is typical of liberal anti-gunners. From your posts, you strike my as a tree-hugger yourself.

It's scary, the mentality of some people. She'd "keep a gun on hand" if Bravo8 was her teacher? And we wonder what's going on with kids who think violence is the answer. She's probably a parent and sharing her "wisdom" with her kids.

Thanks, Rochelle for making total sense. Definitely not the smartest thing in the world to post on a “legal advice” board. Not even in joking. Your short post says it all.

However, HomeGuru, someone who has time to post 19 or more times a day shouldn’t be giving anyone advice. I don’t give a damn how long you’ve been in school or how many life experiences you’ve had. You want to call someone dumb? Hell if you’re so damned intelligent, why are you even responding to stupid ass comments that people make? If you think you’re above it, move on to the person who wants some real advice, since you seem to think you’re so damned educated. You know, I read a lot of the comments here, and I just ignore them when they get too stupid. God doesn’t even have time to argue with stupid people. Ask the people of Sodom and Gomorrah. Oh, you can’t. God destroyed them, because they were stupid. My point? What difference can you make? You think YOU can change them by being an ass? Someone like me enjoys the challenge.

By the way, I fail to believe you are a board moderator. I moderate three different message boards. I don’t make responses to comments that do not relate to the topic, and if they go so far over the edge, I DELETE them, not respond to them.

Why don’t you just step aside and let the rest of the people here who want advice seek it. Or trust that there will be observers like me here, stopping in from time to time (because unlike you, I have a life), just looking for a reason to challenge you.
