doesn't seem right


What is the name of your state? Wisconsin
ok..i was at a friends house and was drinking..it was late and i fell asllep for a few hours..a friend woke me up and wanted to go home..i didn't want to drive because i had drank. She assured me that she had not drank anything and that she could drive. So stupid me..I let her drive me home. It wasn't very far..i fell asleep in the passengers seat..next thing you know we get pulled over..she asks to switch seats because she doesn't have her liscence! The police see us switch seats so they approach her. She fails her tests and I pass...this ****ing sucks! Now because I switched seats with her I'm being charged with OWI.. "operating" is sitting in the driver's seat with the keys in the ignition. Now i'm going to trial to try and fight this. The car was turned off and to the best of my knowledge the keys were not in the ignition...I don't see how I could be charged with with this when I was never even driving the vehicle. It says in the police report that we switched seats and we both admitted to doing so..it was an extremly stupid mistake i know. I am not 21 so an absolute sobriety ticked would be expected but not an OWI! Is there any chance of beating this or am I just wasting my time and money?
