drinkingWhat is the name of your state? north carolina A person has been drinking and is given a ticket for possessing a malt beverage. | Depends on the malt beverage. If it is a chocolate malt, then it is NOT possession. However, if it is a San Miguel, that would be possession. In either case, if the person meets the legal definition of 'drunk' and is driving, then that is DWI.
__________________ There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |

| Is it illegal in your state to possess a malt beverage in your state, or were you under age. Just because it's not in your hand doesn't mean your not in possession. If your in a vehicle and the alcohols in the there also, your in possession. |
