drinking and driving kills passenger chargers???


What is the name of your state? Georgia

True story... Bout a week ago a 17 year old was drinkign and driving with his cousin in the car and i wrecked the car causing his cousin in the passenger seat to be ejected out of the car. He died cause of a dead brain later that night. I'm wondering what the charges that will be upon him and what he will prob get. I think this is unexcusable and he was very stupid.

Someone please respond.

It's pretty much.....

"In cases when drunk driving causes death, the DUI is charged as a felony. In these situations, the DUI statutes define it as a felony if the death occurred in the commission of an unlawful act, not amounting to felony with gross negligence; or in the commission of a lawful act that might produce death, in an unlawful manner and with gross negligence."

Manslaughter is a definitely possiblity.

Who was cited for the accident? Who caused the crash, the drunk driver? If so, you need a Personal Injury lawyer. If you caused the crash, but the driver of the other car was drunk, you may want to talk with a criminal defense lawyer.

Talk about a piss poor job of hiding the fact you are the responsible party, not some imaginary "friend". Yes, manslaughter is a definite possibility. And being tried as an adult too. 5 to 20 years in a state penitentary, $25,000 in fines plus the possibility of civil actions by the victims family.

Everyone who posted nonsense about manslaughter and made up sentences, none of that applies in Georgia.

In Georgia, when you kill someone in a car accident, you are charged with Homicide by Vehicle in the First or Second Degree ([url]http://www.legis.state.ga.us/cgi-bin/gl_codes_detail.pl?code=40-6-393[/url]) or in a very few cases murder.

If the person who caused the death was DUI, the charge is Homicide by Vehicle in the First degree, and the punishment is 3 to 15 years in prison. If the person who was DUI wasn't the cause of the accident, I suppose it would be possible to charge the non-DUI person who did cause the accident with Homicide by Vehicle in the Second Degree which is a misdemeanor punishable by 12 months in jail and/or a $1000 fine.

Also, in Georgia a 17 year old is an adult.
