Driving after consuming alcohol by underaged person/.05


What is the name of your state? North Carolina
To make a long story short, I sped past an officer to be pulled over on purpose because I was in an unsafe situation due to passengers in the car. I explained that to the officer and said I did not know 2 passengers in the car and really do not want them in the car, they started acting strange and hostile to each other. I saw an outline of a law enforcement vehicle ahead of me to the far left. I decided to speed past him hoping he would pull me over and help me get those 2 passengers out of the car. After pulling me over I told him my situation and disreguarded my concern and asked if I was in that part of town to buy drugs. I said no and I am from Texas and do not know much about this area. He ordered all passengers to get out and walk off without searching them or even asking them for I.D. He then asked me how much I had to drink that night. I said honestly I have had 2 beers, and then I ate a big meal at Wafflehouse and a cup of coffee. He gave me a breathalyzer test and I blew .05. He then handcuffed me, and I asked him if he can put on his report the reason I stated I sped passed him because I was looking for help concerning my own safety. He said it wasn't necessary. I did not argue and then expressed my concern about my friend walking away with the 2 other passengers because he did not know them and it was at least 4 miles back to where he was going, not to mention the officer previously telling me it was the roughest neighborhood in the city. He said oh your friend will be alright. I was not read my rights at any point before or after being handcuffed, did not consent to a search of my vehicle, or a breathalyzer test. What can I do? What penalties am I facing? And does the fact that I purposely got pulled over matter at all? I am 18 years old.

What, if anything were you charged with, underage consumption of alcohol?

Yes, I am charged with having alcohol in my system while driving a motor vehicle and being under the age of 21. I was not aware of that law when I moved here or I would never have turned on the car. Can anyone add a few words?

You obviously moved from outside the States, or didn't you know the legal drinking age is 21 in this country!

Assuming it was a DWI, because you were arrested. Get an attorney.

On the paper work I have from the inncident, it says "Driving after drinking by underaged person." 20-183.3
