driving on suspended license


What is the name of your state? ca

alright, my buddy got a dui in sept 04 and had been doing prety good until this last weekend everyone has a totally different answer to my ?s so im going to see if anyones been through this before. as i said he got a dui last sept. and has been attending classes and taking care of it until saturday night he was driving on a suspended liciense due to dui. we left a bar and got pulled over for speeding. the chp gave him a breathelizer and he blew a.056 he told my friend if i was not with him he would have went to jail and car impounded, but i was sober enough to drive so**************.... he got a ticket for violating probation, driving with a suspended and he let us go on our way with me in the drivers seat. he had a speeding ticket prior to getting the dui last year and not much else. my ? would be what is the worse/best case scenierio for him?? some say at least 30 days in jail others say fat fines and thats about it any advice from someone whos been in a similar situation would be great. dont get me wrong im not trying to defend his stupidity, hes a grown man and knows right from wrong but made a big mistake and is going to pay for. id just like an idea of what he is gonna end up paying> time and money? thanks for your time

You said it. He made a big mistake and now he is going to pay for it. The problem here is your buddy got a DUI and was suspendend. He is speeding, alcohol on his breath, and no license. Usually in court the judges hands are tied as to what to do, except go by the laws and his judgement. That's why he makes the decisions and not the offender. If your buddy is a nice guy and the judge wants to not be so hard on him, the judge faces the wrath of Mothers against Drunk Driving and all the rest of the pro non-drinking, and driving groups. It is apparent that your buddy is not learning from the original DUI and suspension so as a person that has been there I would think the judge will take stiffer measures. If the judge is having a good day he may not shoot for the max, but if his day is going badly I would duck as when he hits you with the book, it hurts. Good Luck.

Based on what I've seen, often times a driving while suspended can end up with a fine. But this guy was driving while suspended AND drinking. That pretty much sinks the ship.

Depending on state laws, there can be some leeway with negotiating probation violations depending on the incident. But, again, his violation was alchohol, so he's pretty much showed his cards and the hand says he's continuing to drink and drive. That's torpedo number two.

I would expect him to get hammered pretty good.
