drunk driver kills my daughter


Im in Michigan,on June 8th 2002,my 2 daughters were riding their bikes home from the store when they were struck from behind by a drunk driver,a repeated offender who was driving on a suspended license for drunk driving in Nov 2001,he had other priors too.both my girls were off the road,on right side of fog line as police call it near the ditch.my oldest was walking her bike behind my youngest who was riding her bike,its not clear how he did it yet,but police report and autopsy report says he was going at a considerable rate of speed when he first hit my oldest,it must have threw her in the air ,as she landed on truck,her head hitting windshield,as it was shattered and blood and hair could be seen.after he hit my oldest he got my youngest details on where she was isnt clear either,report says my oldest daughters body traveled 175 on the truck before she was threw off,as when police arrived on scene she was pinned under the right front side of truck and both bikes were crumpled and entangled together under left front of truck.my youngest had severe injuries to her left leg,in 2 places where flesh over a 1/4 inch deep and 10 cm x8-1/2 cm wide,her right leg was broke and she had a concussion plus other injuries.she not to long ago could walk again.my oldest died from major(brain) head and neck injuries.7 broken ribs,a puntured lung,liver damage,she had both legs broke,fractured thyroid cartilage,there is more but this gives you a ideal what he did to her,as i said the guy is a known habitual offender,he had been suspended about 4 times in the last 7 years,he has a fail to stop and identify his self at a accident in 1995 where 3 people were injured.there is more on him but to go on, on Sept 3 he plea bargained ,there was 5 charges on him,OUIL death, OUIL serious injury,habitual offender ,driving on suspended license,child endangerment(he had his own 6 year old son in the truck with him who wittnessed it all)but because he pled guilty to ouil death and serious injury,the other 3 charges were dropped,and he was granted house arrest until he is sentenced Oct 11 so he can organize his life and say his goodbyes before he goes to prison.im told that this is common for them to release people like this who are going to prison,is it? also judge told him he could be facing upto 15 years for the death and upto 5 for the injury,but im told Michigan has something called the 2/3 law..what is that?i was against him being released on house arrest because i felt it was unfair,my daughter did not get to say her goodbyes before she was sentenced to death.and also that he could be a danger to others, but prosecuter told local news that he was little or no danger to the community.according to rap sheet i have,he has 4 contempt of court,4 failure to appear and 1 flight to avoid prosecution(ABSCONDING FL)is what says on sheet,i asked prosecuter about that one and he said it probably meant he just failed to appear.he does not have a tether on,from what im told,the police go there a couple times a day and give him a breatherlyzer test to make sure he has not been drinking.can anyone explain the 2/3 law and the house arrest?the truck had no insurance on it,plates belonged to someone else and the title was in someone elses name.

Im in Michigan, i forgot to mention the drunk drivers BAC the first time police did breathlyzer on scene was.28%,then later it was done at hospital,it came back.22%

I am so sorry to hear of your loss of your daughter and the traumatic injuries of your other daughter. This cannot be easy for you, so I know you will want to get all the information you can to help you cope.

A search on [url]www.google.com[/url] for "drunk driving Michigan" came up with a host of sites, as well as "two thirds law" or "two-thirds law Michigan" (all without quotes).

I clicked on what seems to be a very helpful web site as far as the information on it describes summary of drunk driving laws in Michigan, various legal ramifications for drinking 1st offense, 2d offense, victim rights, Michigan's no fault auto crash laws, etc. You might like to cut and paste the following address into your own web browser and check it out:

I'm sorry to hear about the death of your child. I hope the her murderer is prosecuted to the fullest extent.

Im in Michigan,i really hopes he gets the max too,but after talking to the parole officer,im not sure..i was told when the drunk driver was released on house arrest,he would have a tether or a monitor set up at his residence that would call in at any given time and check to make sure he wasnt drinking or leaving his home..i found out friday none of this is being done,maybe a police officer goes there randomly to do a breathlyzer,prosecuter told local news the drunk driver was little or no danger to community.parole officer said that courts were looking at possibly 52 months to 180 months as a sentence,this is for the death of my oldest and serious injury for youngest,who spent time in a wheelchair,had to have home care nurses and was on crutches.she cant run very well now with out her legs giving out on her or twisting on her.MADD said something about the drunk driver scored high on something????they said that was good,what did they mean?

I am saddend by your loss, ashamed of the system. Im Michigan the person who owned the vehicle and knowingly let someone who has lost their license use the vehicle is also in a world of hurt and can be convicted. This means charges agains the owner of the plates and the owner of the vehicle. MADD has a strong voice in Mi and I hope they presue this. I wonder why they are always concerned about the criminal's rights and so uncerned about the victims.

MARRIED


Michigan,i dont understand any of this,we were just informed that while the drunk driver that is under House Arrest,he got married,how could he be under house arrest and get married,does justice of the peace make house calls.house arrest means he is not allowed to leave his home i thought.

impact statement


Jan 11 1980, the most wondeful thing happened.Jackie was born.she was very special..she taught us alot ,how to be good parents and what a irreplaceable gift from god a child is.we teached her right from wrong..and she was always a well mannered girl.this little Teddy Bear was Jackies first Easter gift. so cuddly like her.she was 3 months old. Jackie was always worried about other people,their health,needs and always trying to make them happy.she always knew she was going places in this world as you can see from her acheivement awards.On June 8th 2002, you changed all that for Jackie,you changed our lives forever,you chose to do something that was horribly wrong..and illegal and dangerous something you had chose to do before. * Jackie and Sheena paid for your dangerous choice.Sheena with serious injuries and Jackie with her life.Jackies life was just beginning,she had hopes and dreams and a futrue,she wanted to get married,just as you recently did.she wanted a family..she would have been a wonderful mother.she loved her nephew.Joshua so much...she was always getting him toys and putting him down for his nap after she got off work,he would snuggle up on her arm and watch movies together.now when we go to cemetary,Joshua sits on her grave and sings Twinkle Twinkle little Star to Jackie,then he says i love you Gee,come home.then he looks up at me and says..Gee night nite.i say quitely to myself,yes she is..forever.Jackie was planning on going to Lansing for a learning seminar on June 12 through Supportive Employment with 4 friends from work..she was so excited about this..she did go to Lansing ,4 days ahead of schedule...June 8th..in a COLD DARK LONELY BODY BAG..she was planning a fathers day dinner for her father,instead.we buried her 2 days before fathers day.Sheena lives everyday reliving June 8th,seeing herself covered in blood and her Sis pinned under the truck,her Sis always looked out for her.our family will never be the same..we will always feel the pain every day,every minute .and Jan 11 being the worst,knowing that was the day God gave us a gift and then June 8th,the day you took her away from us.Gods irreplaceable gift.

... sorree :) it took me so long to respond, I got your email too, but.... I started a new job this week at my former law firm that I was with for 8 years. At any rate and suffice to say, it's been more hectic than I anticipated.

I took a look at your creative website and I think your daughter would thank you for it. After it's been on the web for a while, the search engine robots will find it and people will come to it more and more when they search for specific terms. And you said you knew nothing about creating a web site. You should be proud, it's a very good beginning ;-)

Write Govorner Granholm asking for the death penalty by blood letting or some other painfull method for all of the suffering that happened to you.

last month a guy went to court for a vehicular manslaughter, hit and run accident, failure to stop and render aid and so forth... he left the scene went and got a friend because he thought he hit something, they drove back to where he thought he hit 'something' seen the ambulance and police crews and drove home again, took two days to repair his truck fixing the grill and headlight. Then got arrested..... Threw himself on the mercy of the court requested not to have a jury trial.. the judge gave him two years adjudicated probation and has to pay the child’s funeral expenses approx. 4K.... the county is in an uproar over this... the child was only 13 and they said she was walking on the wrong side of the road.... seemed to be her fault they concluded, his friend testified he was driving drunk, but since he wasn't caught until 3 days later there was no proof other than his friends eyewitness account of his drinking that day... he got off for murdering a child, injuring several others...

tell me, our DA is not worth a chit ha??

Have you considered contacting MADD.. Mothers against drunk drivers to help you with your fight...
