Drunk Driving/ DMV Hearing


What is the name of your state? CA

Just looking for some advice from the experienced.

Was arrested for DUI. Officer's statement is that I was pulled because I didnt have a front license plate. My car was legally registered in another state and had that tag. (He was watching the club from across the street) Anyway, in California you have to beat the court and the DMV. Well they put me in the wrong court, realize it on my court date and transfer me to another and cancel my current court date. That was July 11. I was arrested on June 11.

I beat the DMV hearing because they said he had no reason to pull me based on the fact my state does not require a front tag. All evidence is thrown out. One down.

Now, the DA sends me a letter stating my court date is October 7. Almost 120 days since my arrest and I still havent appeared before a judge.

My question is. Should I risk the fight or plea to reckless if offered? Seems like a long time before having my case before a judge. My feeling is the DA has nothing to lose by trying my case and losing, so he may not refuse to prosecute.

I have an attorney, but would like some other advice.

If you aree going to stay in California, get California or Mexican plates.
