New York, Last night my boyfriends 2005 Hyundai Sante Fe while parked across the street from our apartment was hit and totaled by a Drunk Driver, he just bought this vehicle November of last year from a car dealer, it cost approxiamatly 11 thousand dollars has full collision he has only made 4 payments, is this person liable for the full cost of this vehicle including what the insurance company does not pay? lady_harley47What is the name of your state (only U.S. law)?

The drunk driver is liable for the fair market value of a 2005 Hyundai Sante Fe. It has probably gone down in value since the purchase. Your boyfriend can probably argue that the value hasn't substantially changed since he purchased it.
