DUI 17 update


Kentucky. Update - my son was pulled over because a passenger threw an object out of the car and hit an off-duty cop while jogging. The police gave my son a fst and said he failed it. They checked his locked glove compartment and found a joint and controlled substance. he got a diversion for that. He had court today for the DUI. He pleaded not guilty because he was not drinking or doing drugs. He has a pre-trial conference in August and has a jury trial in October. Can anyone even guess if we did the right thing or what might happen next?

You did what was within his rights to do. Whether it was the "right thing to do" or not, is open to debate.

What did his attorney say?

Any guesses we'd make would be pure speculation.

How about this: Is it the right thing to do to teach your son to avoid taking responsibility for his actions?

If no chemical tests were performed, the case will hinge on the evaluating officer's testimony. Given the fact that marijuana and an unspecified "controlled substance" were found in the "locked" glove box, there is likely to be a great deal of weight given the officer's testimony as there is likely to be a presumption that your son could have been high.
