What is the name of your state? ca

had my moms car and her tags were expired, when officer came to window she then asked if i had been drinking i told her i had a couple of beers in the past couple of hours, she had me do the alphabet walk the line touch my nose, everything was fine, she said i looked like i was drunk, i told her i had been sick with the flu for the past 4 days and thats why my voice was funny and my eyes were kinda glossy, she said i was lying and had me breath test , it was 1.0 . they arrested me and took my license. is there anyway of getting a different charge since i was not initially pulled over for drunk driving until after the fact?

You've got enough evidence against you, including your admission, for a strong case for the prosecution. I'd consider getting a lawyer, or research the penalties for a first offense and get started. The sooner you move on it, the sooner you can put it behind you.
