| I was arrested for Dui in Georgia. I was followed into a private driveway by an off duty police officer in his personal car. He prevented me from getting out of my car until the on-duty officers he had called arrived to arrest me. Everyone else was allowed to exit my vehicle. The off duty officer stated that he observed me on a certain street crossing the center line and that I also had hit a curb. None of which is true in fact the street named in the report does not have a center line or any curbs. How much authority does an off duty officer have? Is it legal for them to go onto private property and physically prevent somone from getting out of their car? Thanks |

| Sen....seek out a lawyer IMMEDIATELY. You have a good chance of getting this dismissed, but unfortunately you will need a lawyer to get this dismissed for you. Since he was off duty at the time he was acting as a citizen. The word of a citizen in a dui case won't hold up very well. Additionally, if you did NOT have your keys in the ignition by the time a uniformed officer arrived, your case is that much stronger. |
