dui-bicycle


What is the name of your state? ohio

Was arrested for DUI while riding a bicycle......refused urine/breathalizer/blood test......was charged with DUI and license was automatically suspended and bike was confiscated.Ive been told by the police department involved I can recover my bike and messenger bag today,1 day after the incident.I posted a $250 bond to get myself out of the county jail,trial date in mayors court at local police station(grandview) is scheduled for monday the 27th.What rights do I have with respect to the fact that a license isnt required for bike use and what can I expect to happen at this point?

A bicycle is classified as a vehicle and subject to ALL road laws. (Though I do commend you with chosing to ride the bike... I have never heard of an adult death due to being run over by a drunk-driven bicycle.)

From the Ohio Revised Code:
"§ 4501.01 Definitions.
(A) "Vehicles" means everything on wheels or runners, including motorized bicycles, but does not mean vehicles that are operated exclusively on rails or tracks or from overhead electric trolley wires and vehicles that belong to any police department, municipal fire department, or volunteer fire department, or that are used by such a department in the discharge of its functions."

And

"§ 4511.19 Driving while under the influence of alcohol or drugs or with certain concentration of alcohol in bodily substances; chemical
analysis.
(A) No person shall operate any vehicle, streetcar, or trackless trolley within this state, if any of the following apply:
(1) The person is under the influence of alcohol, a drug of abuse, or alcohol and a drug of abuse;"

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

license?


Ok Im aware its illegal,the point im wondering about is,a license isnt required ie if I had a state ID only then what?I dont own a motor vehicle and never will again,they can suspend my license permanently and I wouldnt even care**************its just a form of ID for me.Is it possible to request that the state revoke my license permanently and then go get a state ID?Im also aware that the penalties Im facing are like up to 30days in jail and a $1000 fine......Im really tempted to try to take time in jail vs. the fine,I really hate paying the cops anything.....especially in a jurisdiction where 95% of there income comes from traffic fines.My license is suspended and will be for a year......how does the law relate to that given a license isnt req'd to operate a bicycle?
