DUI broken down


What is the name of your state? Florida


I hired a really expensive lawyer that specializes in DUI
defence and its coming down to the end of the court dates
soon. This was my first conviction by the way. My lawyer
had the State test the BAL machine and it failed
calibration. On just that respect, what are the chances of
the DUI getting broken down to a lesser charge or thrown
out. And lastly, in Florida, if you have 3 heavy traffic
violations they consider you a habitual offender. In the
past 5 years, I have had 2 driving while license suspended
tickets, both adjudication withheld. Even if the DUI gets
broken down into a reckless driving, am I still a habitual
offender and is there any way around it legally. Thank you
so much.

I need to be "taken out of the game"? Its people like you who give society and the Justice system a bad name. If you read the post correctly, my BAL will be thrown out because of the County's incompetancy to keep there machines in working order. Anyone with a real opinion or answer to my question?

Yes, here's a real opinion. So you got a good lawyer, he had the calibration checked on the BAL and it failed. So what! You were drinking, correct, or did the cop just pull you over? Give us a break. IAAL is correct, you should be "taken out of the game."

Seriously, why would I, or anyone, really want to help a criminal and a drunk to get back onto the road? Wouldn't that be counterproductive to the best interests of myself, and to society in general? Of course it would. It just doesn't make sense. And, you think anyone wants to help you and your selfishness and uncaring behavior, just so you can drive again and perhaps harm or kill someone. Surely, you can understand that concept.

You can't be serious about this.

Oh, and Brad, in case you don't see the FACTS, here they are from your own post:

1) You were stopped DUI and got a ticket. The fact that the BAC failed calibration doesn't alter the FACT that you were DUI.
2) In the past FIVE years, you have gotten TWO DWLS tickets.
3) Your post makes no mention of why you got your license suspended, but suffice to say, it was PROBABLY due to SEVERAL serious traffic convictions, right??

With those FACTS alone, you are a driving hazard to others on the road. So, let me ASK you a few questions:
a) How long have you been driving?
b) How old are you?
c) How many TOTAL tickets have you gotten?
d) Why was your license suspended in the first place?
e) And finally, the 'kicker', how many times have you driven drunk and NOT been caught??

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

To answer your question, I have been driving for 6 years.... I'm 21 years old. The first DWLS came about because of a mix up at the courthouse not receiving my payment for a SEAT BELT violation. The second was my fault, I forgot to pay a parking ticket. No, they were not serious traffic offenses. I also find it that IAAL has the odasity to call me a drunk. It was one night after taking my friend out because he was getting dispatched to Iraq. We all do stupid things and yes, I had to learn MY lesson the hard way. It's a shame that you guys come out swinging because you thing that I, and probably other normal people who post on here are nothing but hard core misfits, lawbreakers, and drunks. Thanks for trying to help anyway.

Neither of those violations (seatbelt and parking) can result in a FL drivers license suspension!!! The parking violation isn't even a moving violation!!

This confirms it for me. I always suspected that IAAL had odasity.

Actually, I think it is when someone gets a job in Atlanta and is trying to explain its location to a friend. And when the friend finally 'gets it', he says "Odasity".
