DUI in CA/ Learners permit in NY

What is the name of your state? CA and NY

Hi,

I got a DUI in CA and my license is suspended from Jun 17th. I moved to NJ permanently. I have a valid NY learners permit that I took in 2001. Can I schedule a road test and get my license in NY. Greatly appreciate your help.

Thanks,
DUI Victim

No.

I suspect that, like every other state, learners permits in New York have expiration dates. Yours is four years old. Probably no good. Even if it is:

You'll have to get a New Jersey DL in any case. You don't live in New York. If, by some clerical fluke, NY were to give you a license, they will promptly cancel it as soon as they find out about the CA suspension. You won't be eligible to get a new license until you reinstate in California.

Edit Getting arrested for DUI doesn't make you a victim, it makes you an offender. Hope that clears up any confusion.

Thanks for your reply

Hi Curt581,

Thanks for your reply. I have a friend in NY. I am going to use that address to get license. I have scheduled a road test in the end of july in NY. I was wondering if they could check that up when I go to road test or if they miss that one would they check at the time of issuing the drivers license. I can not afford my license. I moved to east coast permanently. I can not take MADD classes in CA and can not get my CA license.

Thanks,

I get it... you're going to falsify a document to try to 'get around' the law. Not real smart.

They may or may not check at the time, but they'll find out about the CA suspension eventually. They'll also find out you don't actually live in New York. In both cases, they will promptly cancel your new license. If you get stopped, you'll be arrested and your car will be impounded. You could also face charges in New York for falsifying a license application.

If you insist on pulling these shennanigans, you're just going to compound your problems. Hope you like Jail.

I'm glad you moved out of California. Stay in Jersey.

Het duivictim, in the words of a New Yorker, "wadduhyuh stooopitt? Yuhdink dey aintgunna figyah dissout?"

You see, it's a very unfair world we live in today. Mostly because, there are these nasty machines that have been tracking our every move. They never seem to forget and when they add 2 plus 2, they get four every time.

They have this ability to remember for eternity, things like our names, addresses, phone numbers, social security numbers, earnings, arrests, and convictions to name a few. They have even learned how to connect our DNA and fingerprints to this information. Worse yet, they can combine, separate and cross check all this personally unique information in the blink of an eye!

If all that isn't enough, they go around sharing this information with all sorts of other nasty machines belonging to many other organizations and government bodies.

And while it still takes us five hours of non stop jet aircraft flight to go from California to New York, these nasty machines can send all there is to know about you that same distance, in a nanosecond!

Plus, you may not be the first person to have pioneered such a clever go-a-round for avoiding the problems we have created for ourselves. In which case, they probably watch for this sort of thing.

Damn nasty machines,,,,,

Hi Curt581 and outonbail,

Thanks for your replies. You made me re-think about my decision to go for a road test. What are the other options I have to save my clicense or atleast to get back after my 4 months suspension in CA. I read somewhere even my suspension is over if I do not take the DUI classes in CA I can not get my license back. Also, when they re-issue I need to go to in-person to re-apply for a license. Is this true??
Thanks,

-Your suspension will not be over until you fulfill the obligations set by the DMV. Your best bet is to get the classes andfines overwith and then move out of state. If you don't you may be screwed.

Most states have a stiplulation on there driver's license application that asks if you have ever been suspended in another state. Marking "No" constitutes perjury which can be a felony....I've actually seen this charged in California.
