DUI in CAlifornia


undefinedundefinedWhat is the name of your state? California
Arrested for DUI per Breath test and field sobriety evaluation. Driver (myself) was on various pain medications as recently had major neck surgery. Arresting officer said I couldn't walk properly nor hold up my head, I explained surgery and hip joint problems, Thyroid gland issues causing loss of balance.

I had no idea one drink would accelerate or impact or have such adverse responses. I was also taking anti-hystimes (Bernadryl), Vicoden (800mg), Valium [(10mg)-to reduce neck muscle spasms], Naprelan to reduce joint stiffness; and Vick's Dayquil due allergic reaction tto local indeginous bush.

DO I HAVE ANY SORT OF DEFENSE OR VIABLE ARGUMENT FOR A "HARDSHIP" OR DRIVE -TO -HOSPITAL AND PHYSICAL THERAPIST ABILITY?

I have other major medical problems including kidney and bladder infections that require me to drive to the hospital weekly for blood testing.

This is second DUI, last and only other was 4 and one-half years ago, also in California, and under similar circumstances.

**A: you have NO DEFENSE for drinking and driving. Do you know how to READ. did you read the disclaimer and contraindications on the prescription notices?

In CA it is a violation of CVC 23152(a) (DUI) to operate a motor vehicle under the influence of alcohol or drugs - even prescription drugs. And the medications you list CAN have a synergistic effect with alcohol and thus enhance the normal impairment you might otherwise have had.

If you cannot safely operate your vehicle due to a medical condition, you have no business driving and putting the rest of the public at risk.

And they will NOT grant you a restricted license if you are not physically capable of driving due to medical condition or drug impairment.

For all our sakes, find another way to the hospital for your treatment. There are numerous transportation alternatives available and many of them are paid for through insurance and public funds.
