HELLO EVERYONE!
HERES MY STORY:
GOT A DUI 1 YEAR AGO...(I WAS AT A .08%) WHICH IN CA ITS THE EXECT AMOUNT TO GET A DUI
ANYWAY GOT A LAWYER HE DROPPED IT DOWN TO A RECKLESS DRIVING BUT I STILL HAD TO ATTEND THE CLASSES...LAWYER TOLD ME I ONLY HAD 12 CLASSES THAT I NEEDED TO COMPLETE..SO I DID (KEEP IN MIND-IVE NEVER BEEN IN TROUBLE, SO WHATEVER THE LAWYER SAID..I LISTENED )..WENT BACK TO COURT JUDGE WAS HELLA MAD BECAUSE HE SAID I HAD TO DO THE 3 MONTH CLASS..AND MY LAWYER WAS RETARDED FOR TELLING ME OTHERWISE..SO HE GAVE ME MORE TIME...
*OH YEAH BEFORE I WENT TO COURT..MY LAWYER TOLD ME TO MAKE SURE I PAY MY CLASSES IN FULL SO WE CAN SHOW HIM MY REPORT SHOWING PAID IN FULL...BECAUSE I DIDNT HAVE FUNDS TO PAY FOR THE RECKLESS DRIVING FINE AND I NEEDED MORE TIME...
SO RIGHT WHEN I DID THAT ...MY CHECK BOUNCHED BECAUSE I HAD OTHER TRANSACTIONS COMING IN WHICH WERENT SUPPOSE TO..AND THEY CLOSED MY BANK ACCOUNT...NOW IM STUCK BECAUSE I NEED THE MONEY TO RETURN TO MY DUI CLASS..SO I CAN FINISH..AND MONEY FOR MY FINE WHICH I GOT AN EXTENSION...BY THE WAY I WAS SOOOO STRESSED OUT BECAUSE EVERYTHING IN MY HOUSEHOLD WENT DOWN ...THAT FOR 1 MONTH I DIDNT ATTEND MY DUI CLASS...THEN I GET A LETTER SAYING IM IN VIOLATION FOR NOT CONTACTING THEM ...WHAT THE HELLLLL CAN I DOOOOOOO IM SOOOOOOOO STRESSED OUT ...THIS IS THE WORSTH THING THAT EVER HAPPENED TO ME!!!!!!...

Wrong!

.08 is the 'per se' limit. That is, that is the BAC level at which you are legally presumed to be impaired. Absent ANY other evidence, a BAC of .08 is sufficient to show legal impairment.

You CAN be arrested and convicted of DUI for less than .08. Think about it logically ... if someone drives a motor vehicle under the influence of prescription meds or illicit drugs, they will have a BAC of zero, yet they can be too impaired to drive. The lowest BAC I believe I have arrested and had prosecuted was, I believe. .043 (it might have been .034, but that seems way too low ... its been a few years).

That was probably a "wet reckless" per CVC 23103.5.

Unfortunately, if you can't re-focus and work something out, you will probably go to jail. You need to see if your attorney can come to some arrangement with the court, then you need to abide by the counseling classes and fine payments.

The whole thing is not meant to be a walk in the park - it's supposed to be a life lesson.

ahhhhhhhhhhh im sooo mad at myself and ashamed!. I know what I did was wrong. AND I did learn my lesson!. and I feel horrible for my actions. well anyway. thank you for your respond.
