What is the name of your state? California
How long does a first offense misdemeanor DUI conviction in California stay on a) driving record b) criminal record? Would such conviction show up on type of fingerprinting/bonding done for a part time (non driving, teachers aid, does not even require teaching credential) job at a California elementary school? Will it affect ability to be hired? Can such a conviction be expunged or sealed on the persons record? How?

Expungement/pardon

There are several thousand questions on this forum similar to yours. Thus, I have prepared a standard answer.

Standard answer: Expungement is generally granted for illegal arrests or unlawful convictions. Generally, pardons mean you are forgiven for the crime but it remains on your record.

Check with the governor or attorney general of your state to see how you can go about either of these procedures. Check with the Attorney General or the President for federal expungement or pardon.

You must remember that there may be private background check companies that have past offenses on their databases; those reports will never be expunged.

-The conviction should show on your DMV record for ten years. The conviction will also be on your criminal history forever unless is it expunged. It should show on any background checks conducted by the school. Whether or not it will affect your employment is up to the school.

Actually, I think you confused the "lookback" period and the DMV record. The lookback period (for use of prior DUIs as enhancements) is ten years. The conviction should remain on the DMV record for 7 years, and on a criminal offender record forever ... or until expunged.

-You are right Carl, my appologies. I made an assumption (which is bad in our line of work) and assumed that the DMV record followed the new ten year mark for enhancements.
