Dui With Cdl First Offense


What is the name of your state? INDIANA

OKAY I GOT A DUI IN A COMMERCIAL VEHICLE, WHERES MY SIGN ?
IT IS MY FIRST OFFENSE AND I BLEW A .18 , THIS IS SOMETHING I WOULD NEVER DO UNDER NORMAL CIRCUMSTANCES BUT WAS PRESSURED BY MY COMPANY TO TAKE A LOAD I TRIED TO REFUSE BUT FAILED TO TELL THEM I WAS DRINKING. SO STUPID IS IS STUPID DOES.
ALSO I HIT A PRKED CAR AND LEFT THE SCENE OF AN ACCIDENT, I WAS CHARGED WITH OWI AND LEAVING THE SCENE OF AN ACCIDENT AND PUBLIC INTOXICATION. MY QUESTION IS CAN A GOOD ATTORNEY GET THE CHARGES DISMISSED ? BECAUSE I HAVE BEEN TOLD WITH ENOUGH MONEY IT COULD HAPPEN. IF ANYONE KNOWS ANYONE WHO CAN HELP PLEASE I M ME.

This is not good.

The legal limit for you, being that you are a commercial driver's license holder, in Indiana is .04. You were way over with a .18.

For first time offenders of a OWI you could be looking at possible jail time of 60 days to 1 year and/or possible fine up to $5,000. Also, anyone who tests higher than .08% BAC, triggers an administrative suspension of their driver's license for 180 days.

Now perhaps some good news, Indiana offers a "deferment" for 1st time offenders. This may be offered and you would be required to complete an alcohol evaluation and treatment program or whateaver conditions they put in place. If upon successful completing it, your charges for OWI would be dismissed. A person qualifies for this only one time.

If anyone had been seriously hurt or killed in the accident you had, you most likely would be looking at felony charges for the OWI.

IMO, you will not be successful at getting all the charges dismissed. Hire a good attorney and hope that some may get reduced or dropped.
