DUI charges reduced to domestic violence


What is the name of your state? Nevada

I was in an auto accident in 4/1997, I was the only one involved, they took blood for alcohol level. When I went to court for no seat belt, and no insurance, the dui charges were never brought up. Attorney said he didnt bring it up because it wasn't mentioned.
2 years later when I went to renew my license i found out charges were filed for a dui on 9/1997. I contacted my lawyer and we went to court, I had previously had a dui in MA in 12/1995. They treated my 9/1997 charges as a first offense with time served and I paid a $340.00 fee and attented a victim impact panel. He also stated that if i received another dui he would take in to account both of them. I finished everything 12/1999, and case closed. Now 9 1/2 years later after losing my job of 10 years I am having difficulty finding employment due to my criminal background. The charges from 9/1997 are showing dui-2nd offense, and the disposition date of 12/1999, and that charges reduced to battery - domestic violence, restitution paid, victim impact panel, fine. Can a dui charge really be reduced to domestic violence; the two have nothing to do with eachother. I know show I have a violent back ground. The lawyer I used back then has recently gone over to the prosecution side and has not returned my phone calls. I have nothing on my record since then, and their are no infractions on my 10 year DMV report. I've been looking for work for the past 8 months and this is really causing a problem for my family and I. I need to resolve this matter and have it off my record, and not showing a violent crime on it. What can I do. Thank you for this prompt attention to this matter.

If it is as you say, sounds like someone elses record (DV) got into your file. I suggest you start a 'paper war' with the courts and state to try to find out how that charge got there.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Something is bad wrong here if a drunk driving charge is showing up as domestic violence.

What does the court say when you talk to the clerk?

Do what SrJudge said:
Get whatever documentation you have which shows the DUI reduced to DV & take it to the clerk at the courthouse where the case was heard.
Show the clerk. S/he (or the supervisor) will know how to correct this.

reply to dui to domestic violence


I ordered my case file and just waiting on it. the only thing I had to go on was a copy of what the credit bureau copied off my criminal record. I had a dui in 1995 in Mass. and then got the one in my accident in 1997 in nevada , las vegas . The first dui is not listed but the dui i got in 1997 shows up and says dui second offense, isnt that nice , just to let everyone know including the job i cant get , that i do have another one. then the disposition says charges reduced to battery domestic violence which is a gross misd. if im correct. Thats a higher charge than dui and whats the sense of reducing if your going to list both. thank you for your replies and help. Im probably with my luck going to have to seal the record and I'm sure that will take forever and I need this job and they are not going to wair forever. Any advice on ways to speed it up .

Well, it's the credit bureau which is listing the wrong information.

The court file may be correct - the credit bureau may have picked up someone else's info (similar name, whatever).

If I were you I'd post for Ladynred on the Debt/Collection section - I think you should dispute the info the credit bureau has - she can advise you of how to dispute & direct you to a site (creditinfo or somesuch) which has sample letters, etc.
Ladynred is very helpful & pleasant & is a frequent poster. The credit bureau info is her bailiwick and she's excellent. Debtguy & Debtcollector are also excellent & very helpful.

If the issue is the credit bureau, those three are the ones to ask, in that section.

PS: I's still have the court clerk check my criminal file to ensure it isn't the court reporting it wrong on that case.

Check your state laws regarding expunging past crimes or offenses


I would check your state laws or statutes that deal with expunging criminal convictions. I know that Utah will let you expunge your criminal record, but Arizona doesn't. So check your state laws or statutes (usually in the criminal code section). You may be lucky and live in a state that is forgiving.
