DUI Cumberland County PA


What is the name of your state? PA
I unfortuately was stopped and charged with DUI in Cumberland County PA. MY BAC was .125, the middle tier.
I've read up on the ARD program and my lawyer says I most likely will get accepted. I have no criminal record, not even a ticket. My being stopped was also not part of any accident or traffic violation as well.
I've read ACT 24 and it states that when accepted to the ARD , with my BAC, I will lose my license for 30 days.
My lawyer states that I could lose my license for 3 or 4 months!
I'm wondering why the difference between the ACT and what he is saying and also looking for folks who have been in the ARD for first time offenders and how long they lost their license for?

I've tried to answer your questions in the other PA thread. You may lose your license, you may not under ARD. No DUI case is ever the same,but you're more than likely going to lose it for 30 days. If you just got busted,there's nothing you can do right now other than to start planning and stop drinking and driving.

Yes, sage advice. A bit out of character for me, but no excuse. Not sure why my lawyer says up to 4 months, he says he is perparing me for the worst, but I would rather have the reality. 30 days is something I can handle, 4 months is not. Needless to say, not a big drinker before, but haven't had a beer in two months and at this point I'm not sure if I ever will have another one. Its all been ..... quite embarresing.

Everyone makes mistakes,be thankful you didn't injure or kill anybody. The best thing you can do is to learn from your mistake, change your ways, and educate yourself. You've got quite a challenge ahead of you. Your case seems pretty 'mild' compared to others,so you have a very good chance on getting in. Although, I probably would've gone with the PD if I were you.
