Question

DUI from DNR...how will it affect MVR?


What is the name of your state?
GEORGIA

Does anyone know if/how a charge of DUI from the Department of Natural Resources (DNR) on a lake in GA (lake is in Hall County, driver lives in Fulton - if any of that matters) will affect the person's driving record? This person has 3 DUIs from the DOT from years ago. His license was suspended for a few years, and he went through the steps for an HV license/Worker's Permit a year and a half ago. His driving record was due to be cleared of the DUIs as of Nov 2003, however he received this DUI from the DNR on the lake in July 2003. The result of the DNR's charge is that he may not operate a vessel upon the waters in the state of GA for one year, after which time he much complete a DUI Risk Reduction Program and then submit a written request for reinstatement of his vessel operation privilege. Just wondering if anything will occur with his driving record...

ok, ok, wisecracks aside please


I agree with the sentiments - I certainly wish I had the magic words or pill or whatever to use on this person, and every other alcoholic who hurts themselves and the people who love them. Yes, you'd think they'd learn at some point! But clearly there's a world full of those who don't learn. God knows I'd be a millionaire if I had the power to 'make them' - wouldn't people be banging down my door?

But in the meantime...does anyone know what is likely to happen here to his driving record from a legal standpoint? I just need some sound legal advice here. Don't need the emotional advice - already going to Al-Anon and counselors to deal with what's happening to my marriage. I have financial obligations, such as a home, and a future of my own, that I'm having to deal with very unexpectedly on my own, and am trying to find out what I'm looking at in the short term with his ability to contribute NOW (he's a functional alcoholic - a 'weekend warrior' - so as of now, the bills have been and are being paid - and yes, I realize at the rate he's gone backwards I have to get out now to avoid lifelong financial and emotional hell).

I'm just trying to figure out legally what will likely happen to his current 'freedom' and ability to work so I can better plan for my immediate financial well-being.

Of course the answer is no because we are not the police who arrested "this person", nor are we the attorney or the District Attorney who are involved in "this person's" case, have not seen his file and are not the judge who might have awoken in the morning and had news that his daughter was killed by a drunk driver or that he was going to be arrested by the police for a felony hit and run that he doesn't remember because he had five too many last night at the local Bar Association mixer.

In other words, how do you expect us to tell you "What to expect" when we don't know jack about the case.

Expect anything from probation to the death penalty.

I know if you refuse BAC testing, you can lose your privledge to boat, but it does not affect your driver license in any way.

I am almost sure in NC that a drunk boat driving (for the lack of a better word???) is the same as a DWI. Atleast I remember a case about 4 yrs where one of my insured's was convicted of driving while intoxicated while boating and it carried the same insurance points as a DWI.

A BUI can affect your privilege to operate a boat, but does not cause revocation or loss (due to suspension) of your driver’s license in Georgia.
