DUI expungement and US Coast Guard


California

I am applying for a USCG Captain's license. I had a DUI in college 20 years ago. I understand I can have the record expunged after 7 years. The CG requires notification of any arrests. IF this is expunged, will the record show up in their search?

It might. Depends on where they look. If it were to be expunged, it would be removed from an official CA criminal history.

That doesn't mean it'll be removed the arresting agency's records, or from the Court records. It will probably also be in databases of private companies that 'buy' criminal history records to resell, like you find on some websites.

More than likely, the record will still exist somewhere.

Is there a paper application you have to fill out? Does it state anything?

I don't know about your specific situation, but our security clearance form stipulates that if an incident has been sealed or expunged, you should not list it. I've seen clearance applications for other companies do the same - if it's not expressly indicated, check with someone in charge there to see whether you should list expunged or sealed incidents on your record before you go to the court to get 'em expunged.

All government agencies use fingerprints to check your background... They are bounced off of the FBI database, and will come back with the arrest.

That is why they are not asking for convictions, but arrests. You have to report it to them, no matter what. If not, you will be denied for failing to disclose the arrest.

expungement In Mississippi


I am trying to get a license to practice medicine.. I am wondering if a misdemeaner is expunged by the court does in also get taken out of NCIC and similar data basis or do I still need to report the arrest to the Medcial board and employeers, etc.

If it is taken out of NCIC, then what is left in? Nothing? Just the arrest? The details of the charge for the arrest? Then who if anyone can go back and look at the record? Does it vary by state. Bottom line: I am afraid that the simple fact that I was arrested (and not found guilty) will be used to deny me a license becasue of the type of charge and because of my prior difficulty in performance in residency. Please help.
