dui on federal landWhat is the name of your state? WASHINGTON STATE i recently got a dui on ft.lewis washington. i took a wrong turn and ended up at a guard gate.i refused the breath test and was taken somewhere on the base-i am not military got a letter from cvb-what is this and why am i being charged with dui after refusal of the breath test-i thought it was just revokation of my license HELP ME I DONT KNOW WHATS HAPPENING |

| It is probably because you were observed impaired to such a degree that they felt there was enough to charge you with DUI. You really thought that you could get a pass on the criminal charge simply by refusing the test? - Carl

| The state of Washington and Fort Lewis have a compact allowing the enforcement of state traffic laws on federal property. My mother just happened to work for the JAG's office when this agreement was made in early 80's. You will be subject to the same penalties as those busted on state roads. Which is probably a good thing considering federal DUI laws are a bit more stringent than state laws. Hiring a lawyer would be a first good step. BTW, refusal of a breath test in Washington carries an automatic one year suspension of your driving priveliges, even if you are found not guilty in court.

| Racer83 is partly correct. State criminal law is enforced on all federal property by virtue of the United States Code. The Assimilated Crimes Act (18 U.S.C. 13) is used mostly for traffic offenses and for other criminal laws that are not covered under state law. For example, the United States Code does not have a charge for operating a private vehicle under the influence, so the state code would apply. Quote:
