DUI in Florida... 2nd offense?


What is the name of your state? Florida
This past weekend, my nephew who lives in Florida was arrested for DUI. He is also on probabtion for a previous DUI that occurred 2 years ago in Delaware. Under these circumstances, will Florida consider this to be his 2nd DUI offense? Also, is there any mandatory/minimum jail time if he is convicted? I suspect he will be retaining an attorney, but I wanted to get some opinions from this forum.

If second conviction within 5 years, mandatory imprisonment of at least 10 days. At least 48 hours of confinement must be consecutive. Not more than 9 months. With BAC of .20 or higher or minor in the vehicle: Not more than 12 months.

He should not try to appear without a lawyer for a second DUI.

Thanks for the reply. Since his first offense occured out of state in Delaware, would this charge in Fla be considered his 1st or 2nd offense?
