DUI + marijuana pipe found

What is the name of your state?kansas
The cop found a marijuana pipe when searching my car. He didn't charge me with it, but said it would be used as evidence. One lawyer I talked to said he can and probably will use it as evidence and charge me for it later. Is this true?
