dui oregon

oregon, my son got a DUI in JUly 09 court date 8-3-09 plead not not guilty to qualify for diversion program, and accepted, weeks later it was denied because he has a comercial drivers license. had new court date which it was postponed at his request. he is now back to work out of state and can not make the next date. requested a month extension, was denied but did not find out until today and the court date is MOnday can I as his Father appear in his be half. and request another date? The whole deal about the diversion denial is ???? and he already was arraigned once??? any ideas??
