DUI in the past


What is the name of your state?What is the name of your state?

Arkansas

I am now 37 years old. When I was much younger 22 I received a DUI. I am now in a medical profession program that requires felony checks. Will this show up when they do a criminal check? Does it ever go off of your report? If not is there anything I can do to get it off or removed. If this shows up I can not take the board exam. Any advice you can give would be appreciated.

I don't know the anwser but I hope you can. You shouild't have to pay for this the rest of your life. I know here in California it comes off of your DMV record after 10 years now. I read this in the local paper. They just increased it to 10 from 7 which I feel is over kill. You might can get it off if you have done everything they said. Finished pobation, paid fees and programs.

Depends on the laws in your state, and what type of background check it is. But it's a background check company's' job to tattle-tale on you.

In my state, the DUI is a misdemeanor not a felony, unless you get a 3rd DUI within 7 years. So if I were to get a felony check, they may not show up.

There are many things about current DUI law that's overkill. The most notable is license suspension overkill. Considering that 70-75% of people with license suspensions drive anyway, license suspensions do nothing more than serve as political symbolizm.

Does a misdemeanor come off your record after a period of time?

Depends on the laws in your state. Some states drop it off after 7 to 10 years, others leave in your record for life.

I agree with you. Leaving it on your record for life or even 10 years is way overkill. The problem with this is that there's no distinction made between those who choose to not re-offend, and those who do. Those who don't not re-offend should have it dropped off their record much sooner than those to choose to re-offend.

DUI law (in its' current form) does nothing to enhance public safety. People have to drive. It's a law of life in our society. The only thing exorbitant license suspensions do it put a bunch of people out there driving on a suspended license. And they're driving without the intoxilizer interlock in their cars. The public would be much safer if offenders were forced to install intoxilizer interlocks and just allowed to drive. Yes, there would be a very small minority that might disable their interlock, but that's much less risky to the public than the way things are now.

Convicted of DUI in CA in Mar. '97


I understand that the law in CA has changed and that DUI's stay on a drivers record 10 years vs. 7 when I was convicted. It's the only DUI I've ever gotten and I am swiching Ins. Companies 8 years later.

I had an out of state license and took the DUI Course, but since I had a MD license and moved 6 mo. later (I was there temporarily) it was never picked up by my insurance.

Will CA have this on my record since the reporting period was 7 years when I got the conviction, or will it be on for 10 with the new law?
