DUI on Pot


I live in Missouri.

In the beginning of this month me and my friends were driving around smoking a blunt and I wasn't paying attention to a dead end sign and I proceeded to drive right into a sheriff (not literally, but he was in there in the dark late at night, doing paperwork I suppose). I slowly backed out and then he turned his lights on and I end out going to jail after he says I'm too under the influence to drive after giving me the tests and such. I had no BAC or anything and I got charged with a DUI, C&I (for backing out into the wrong lane, but there wasn't even any lanes, it was a dead end!), and possession. The pot wasn't mine and my friend admitted it was his but all of us got tickets for possession, because we were all smoking it and I decided to stay the night in jail rather than bond out.

It was about half of a blunt found in my car, that another friend admitted to trying to throw it out the window (and we thought he did) and the officer found it on the floorboard in my backseat. I was the only one who went to jail, for the DUI.

I have 3 prior tickets and am currently on 2 years unsupervised probation for possession (of pot) which I have been ticketed for twice within the last year (all under 35g's, thankfully.) I did community service and took a class for the first misdameaners (Possession of C/S under 35g's and Paraphenalia and I know I butchered that word, misdameaners) and the second I paid a three hundred dollar fine (possession under 35g), and this was my first actual arrest, the other two were on school grounds and I just went to municipal court for both of those.

Basically, am I going to jail? Can I do anything to help my case when I talk to the prosecuter? Can I fight ANY of this? Lawyer or public defender? I'm only 18 and have had all of this **** happen, I figured I'd have learned my lesson (I had the attitude of no one gets caught once, definately no one gets caught twice, sure enough 3 times!) but I'm done with drugs regardless of what happens and I'm taking this as a god send of sorts and come to realize I can't do it without getting in trouble and it's not worth it. I'm still young, if all of this has happened and I keep using, I'll end out rotting in jail forever and I don't enjoy working my ass off at a $7 an hour fast food job just to have my money pay off ridiculous amounts of fines. Sorry, I kind of went on a rant.

PS: The police offer told me since I was so cooperative, he wouldn't charge me with possession and would only ticket me for it and just charge me for the DUI? What does that mean? It seems to me I'd be charged if I got a ticket.
