DUI probation violationMy friend in Pennsylvannia was on probation for 2 dui's. she was doing well and had nearly completed the probation when she failed a drug test for marijuanna(she had small quantities of marijuanna at both arrests). I was wondering whether she would be going to jail or whether she could avoid it by some means of throwing herself on the mercy of the court or her P.O.? thanks for your help Steve |

| Let's see.... 2 DUI's Marijuana in both instances Easy sentence of probation Then, a probation violation for using marijuana--the drug that partially put her on probation in the first place Why should there be any sympathy? Hopefully, she'll do time. If for no other reason than she is too stupid to be "on the outside" |

My response: And who the hell are you, "Zippy the Pinhead"? No, she's not a "nice" girl - - she's a "selfish" girl, who's looking for her own self-gratification at the expense of the public. She's a danger to society - - but you don't want to understand that. When she's intoxicated, and behind the wheel, she's only thinking of herself, and not the potential of running humans down in a cross-walk. And, she didn't make "a mistake". She made MANY "mistakes". Apparently she has a short term memory problem. But, some time behind bars ought to cure that little problem of hers. This is the way "society" thinks, and she's about to find that out the "hard way" when she appears before a judge. IAAL |

| f*ck you, she hasn't driven let alone driven drunk for 2 years, and i am sorry that you are a saint, and i guarantee you have driven with a ba of .07 which is what hers was, the only difference is she was a minor, so go f*ck yourself and don't respond if all you are goin to do is talk **** like you are a perfect individual...cause i am sure you have skeleton's in your closet too, mr angel |

My response: Then, I guess I'm "perfect" by your definition, simply because I have never drunk alcohol and driven an automobile. It's simple, because I "think". It's also simple because I know it's against the law. It's also simple because I know that drunks kill people. Your selfish friend, Zippy, was on probation. She's going to jail. This is another simple concept. You see, I'm an attorney. It's my job, and my promise, to uphold and protect the laws of California. I don't intentionally make the same mistakes over, and over, and over like your selfish, unthinking, uncaring friend. She's going to jail whether you like it or not, or whether I'm the one telling you. It's a foregone conclusion. IAAL |

| thats great thanks buddy, and i find it hard to believe you have never driven after a beer, which is what she did, but she was a minor, and i am not defending her, **** i don't even like her she is my girlfriends best friend, i was just inquiring as a service to my girlfriend...and i don't need pricks who are high on themselves giving me smart ass comments, you would be found in contempt if you talked like that to any of the judges i know. a simple reply with your opinion would have been plenty, but I guess it is much more fun to preach since you are such a great person... |

| My response: You think I'm preaching? Just wait until the judge has his words with her. That's going to be real preaching! And, then, she's going to have representatives of MADD in the courtroom too, looking and staring at her, and keeping their scorecard on the judge - - and you better believe that when they're there, the judge knows it, and understands that his job depends on that "voter" block that MADD wields around. And then, when she's behind bars, that's when the bible thumpers start talking to her, bending her ears until they bleed. And she can't get away from them, either! Oh, no my friend - - my preaching isn't near as bad as she's going to be getting! Good luck - - she's going to need it. IAAL |

| so let's see. she had one dui when she was 17. How old was she when she got the second dui? So she hasnt driven a car in 2 years as far she has told you or your girlfriend. She is still doing drugs and still getting drunk. One doesnt typically give up one drug and keep on with the second one. Plus, she knows she is undergoing testing while on probation and still knowingly uses weed. Is that a mistake? It's the amateur drug/alcohol users like your acquaintance that make it hard on the professional drug/alcohol users who dont get in trouble but still face the scorn of society. ![]() |

My 2 cents worthSalt: I suppose your friend has had a drug/alcohol evaluation because of her charges. Yes or no, she should contact an eval and/or treatment center. If they want her on inpatient status, then she should check in. She needs to get some counseling under her belt, quickly. The problem here is that she has a problem with not only an intoxicating substance but an illegal substance as well. She has not learned that she cannot use such substances. The Court has given her an opportunity and she has failed to take advantage of that opportunity. Tell her to get some treatment, go to NA meetings and get her act cleaned up. I would also suggest that she be honest about the situation and admit that she has a problem, a weakness and that she is seeking help for that problem. Judges know drugs are a problem. Treatment and abstinence is the answer, not incarceration. She may want to agree to do a few days in jail and go to treatment. By the way, you are right, good people make mistakes. The idea is to learn from them. Good luck. |

My response: Yes, you're bound to find a Liberal who'll give you a nice, soft pillow to cry on. We have them here too, and Liberals who'll tell you to "get treatment, she can get better, she's got a disease, etc., etc." Well, you already KNEW to tell her to get treatment! You undoubtedly already mentioned this to your girlfriend to tell her, or she's had numerous other people tell her this - - including the courts! So, beyond giving you a "blanky" and a nice, soft pillow, what did that response do for you? Nothing, because it wasn't based on her future reality. Do you really believe she's going to get "treatment" on her own? If she gets any help at all, it's because it's forced down her throat - - and even then it won't help. She's already proved that by violating her probation! She's a menace to society and needs to be locked away. And guess what? With her record, and probation violation, she will be. IAAL |

| Actually Mr. I love labeling people, i know most of the judges in my city personally, and the one who's father is the head of the county republican party is the most lenient...so you stereotypes and label are wasted and asinine |
