DUI Probation violation


What is the name of your state (only U.S. law)? Connecticut

My 40 year old son has big problems. Started in Feb. 2008 with a DUI conviction. While on probation he had a 2nd DUI in June 08 and received 180 days in jail. He was released in March 09 but he is on probation for 2 years.

A few days ago he was arrested for 3rd degree assault and disorderly conduct. He went to court on his own and all he will tell me is that his case is awaiting disposition. What can we expect will happen here ? Obviously he has violated probation.

He could get a year on the new misdemeanors. The fact that he was in violation of his probation will probably affect the judge's discretion in the matter. He will also get a hearing on the probation violation. That could result in termination of the probation, extending the probation, or more restrictive terms. What is likely to happen is hard to tell. Hopefully all this has been disclosed to his lawyer and lawyers are usually familiar with the court in which they will appear and can give and idea as to what will happen.'
