A friend of mine was sentenced to two six months sentences to run concurrently for DUI and driving under suspension. After 90 days, they released him and put him on probation. He wasn't supposed to drink while on probation. One morning, he went to see his counselor, and she smelled alcohol on him from drinking the night before. She told him to report it to his probation officer, which he did and was put back in jail. The next day, when he went to court and they asked him how he pled, he told them he wanted to speak to his attorney (public defender,) so they postponed his trial for two weeks.

On his trial date, his attorney stated she was not ready to present his case and asked for a postponement. That was two weeks ago, and he still has not heard from his attorney. A friend found out for him that his new trial date is not scheduled for another 3 weeks. By the time he even goes to trial he'll have been in there about six weeks.

On top of it all, they say he's looking at doing 9 months. How can he do nine months if he's already done 90 days of a six-month sentence?

Can anyone give any advice? Thanks!
