Dui restrictions


What is the name of your state (only U.S. law)? VA

I orginally asked a question about husband getting a dui in Oct. 2007 and he completed everything that they required, and was doing very well until one night he was stopped in another county within the state with his restriced license. What can the judge possibly do when he goes to that particular court for driving outside of his restrictions? He had no other problems other than he was driving outside of those time restrictions.

There are a number of things that can happen, and a lot would depend on the circumstance and which court he was sentenced in.

The judges in Fairfax for example, explicitly warn that violating the restrictions on the license could result in them reimposing the suspended jail time. Your husband could be looking at some time in jail.

The judge could revoke the limited driving privs or extend the period of license suspension.

He could be charged on driving while suspended as well.

That seems to be the prevailing punishments in Richmond as well, from everything I've seen. The judge in my case made a specific note regarding the jail time if I committed the offence you have mentioned.
