DUI should be a felony?What is the name of your state? CA I know a couple of people that have a felony for a drug possesion charge. I have a question that always bothers me in the name of fairness? Why is possession of a drug for personal use, and not used while operating a vehicle a felony, and a DUI not a felony when you could have potential killed someone else? I'm talking first offense in either case. |

| The simplest answer is that alcohol is a legal drug - legal to purchase, to possess and to use. |

BigMistakeFlPart of the problem with drunk driving is that it is legal to drive after drinking, but not to the point of "impairment". And whether or not a driver has reached that point is left to the drinking driver to judge before he or she gets behind the wheel.
