DUI should be a felony?

What is the name of your state? CA
I know a couple of people that have a felony for a drug possesion charge. I have a question that always bothers me in the name of fairness? Why is possession of a drug for personal use, and not used while operating a vehicle a felony, and a DUI not a felony when you could have potential killed someone else? I'm talking first offense in either case.

The simplest answer is that alcohol is a legal drug - legal to purchase, to possess and to use.

Part of the problem with drunk driving is that it is legal to drive after drinking, but not to the point of "impairment". And whether or not a driver has reached that point is left to the drinking driver to judge before he or she gets behind the wheel.
