What is the name of your state (only U.S. law)? North Carolina
My question is: My husband has 2 previous DWI convictions in the past 7 years, one in 2003 or 2004, the second in 2008, and now a third charge in Feb. 2009 where he blew a .13 and was videod on his scooter, what would be the benefit of an attorney? What are the consequences he could face as far as sentencing, jail time, etc. He just completed a court ordered DWI assessment treatment course within the past three weeks. Can you please advise us on his best approach, should he get an attorney or should he plead guilty and represent himself? He has always had an attorney and we are not certain as to how beneficial one would be for his case this time.

He might have escaped second offense penalties for last years DUI, he won't this time. It will be treated as a third offense. He could be looking at $2000 fines and two years in jail. He'll get a permanent revocation of his license. Permanent means he can't even ask for reconsideration for five years.

If he was on probation for the previous offense, he may be violated on that one as well adding to the penalties.

Yeah, he needs a lawyer. Sell the car/scooter/etc... trade in the money on a lawyer and a bicycle.


Oh yea, and one more, and it's a felony with minimum of a year (not suspendable) in jail.
