DWI Probation Violation in NC


What is the name of your state (only U.S. law)? NC

My girlfriend had 2 dwi's back in 2006 and served 7 days in jail earlier this year. She went to pick up our daughter earlier today only because our little one had no other way home. when she got home her PO was sitting on our doorstep for an unsched visit. my GF never drives. I always do. but now she is worried that she is going to be sitting in Jail for the next year because of this. I am gathering that she will be at least 30 days, but does anyone know how much longer than 30 days she would have to be in for????? we are a two income family and need both to stay a float. any information would be greatly appreciated!!!!

It's going to be up to the judge, with the probation officer's recommendations, for how long your girlfriend will be in jail. She didn't have to drive. She could have called a cab, called a friend, called a family member, taken a bus, etc. She knew not to drive, and did so anyway.

If she were my probationer, I would not believe her if she said this is the only time she ever drove. It's just too coincidental that the ONLY time she has driven is the one day that the PO decided to do a home visit. My opinion is that this is the first time she got caught, not the first time she drove in violation of her conditions of probation.

I'm a probation officer.
