DWI in VirginiaWhat is the name of your state? VA On August 23rd, 2007 I received a DWI driving the wrong way on a one way street, it is a very confusing street even if you are sober. Anyway, I was pulled over and was given a series of sobriety tests, after that it was determined that I had something to drink. I was then taken to the police station where I blew a .12 and was put into lockup and then taken to jail where I was bailed out at a $500 bond (friend paid $75 to get me out) 13 hours later. In the past I have also received an open container and a drunk in public, which I just paid off and I was 21 at the time when I got those. I am wondering whats going to happen next and will the drunk in public and an open container will impact my first DWI/DUI? I appreciate all your help in advance. |

| There's only a 7 day administrative suspension in Virginia. However when convicted you will pay a fine up to $2500 and may spend some jail time (this is at the discretion of the judge, depends an awful lot what court you appear in). On a high BAC, you probably will spend a few days in jail in many jurisdictions. You will lose your license for a year on conviction (no discretion on this) but at the judges discretion you may get a restricted license. Around here they will frequently require a hard suspension for 60 days before they'll consider a restricted permit. You will further be required to submit to a VASAP (alcohol awareness) course. You will also (unless they repeal it) pay a $750/year DMV surcharge for three years. |

| A high BAC (.14 or above) in VA usually carries a 5 day jail stay. This is up to the judge. You will also be required to complete a 26 week ASAP (Alcohol Safety Awareness Program) and the judge may also ask that you attend a Victim impact panel meeting sponsored by MADD. Your license will be adminstratively suspended for 7 days, and upon conviction, it will be suspended for a year. You may request a restricted. Virgninia doesn't play. My suggestion to you is that you pay the fine in full when sentenced. I know someone that was arrested in VA and had a hard time paying the fine. What a nightmare. Do what you need to do to pay the fine. Get a lawyer too. A public defender won't be much help. |
