Electric Wheelchair DUI

So we were just looking out our front window at dinner tonight and saw a crippled man putting around in his electric wheel chair. The problem is, HE was obviously drunk. Paper bagging what looked to be a bottle of Zambuca. He randomly bumped into a small chinese girl and broke her ankle. The drunk "hozer" then proceeded down the sidewalk like nothing happened in his alcholic haze.
So the question is, can a person who's only mode of transportation is his or her wheelchair be charged with a DUI? If not....where can I get my hands on one of those mobiles.
