First DUI (mortified)


What is the name of your state? Colorado

This is absolutely mortifying for me. However, I'm just curious about what I can expect in the upcoming months.

I had three glasses of wine....and drove home. I was pulled over for failing to stay in a single lane. (tired as well)

When they asked if i had been drinking, i told them three glasses of wine. i was then asked to take the roadside test. i agreed, and took the test. (high heels no less) and consequently failed. (p.s., i dont think i could pass that test sober!!)

i was arrested, and taken in where i blew 0.112 on a breathalyzer. This is a DUI in colorado. i have been given a temporary permit for seven days. should i request a hearing? i am absolutely in the wrong, and not sure that it would do me any good.
i do take several prescription drugs as well (paxil, xanex, zyrtec) for an anxiety disorder, which when taken, can cause me to be a little tired. yes, i KNOW i should not have been having wine or driving. Now i would just very much like to know what to expect. and if i should get an attorney?

A lawyer not going to do any good,best just take your punishment the best you can.Work around it,dont tell your boss,keep it quite if you can. Good Luck .

consult with an attorney that specializes in DUI. It may cost you some bucks but a reduced charge or lesser fine may be worth the cost. Remember, a DUI conviction will jack up your insurance rates to the clouds.

Like I said,The lawyer not going to do nothing.Your insurance is still going to go up.You will still lose your license.You will still get the points on your record.You will still pay fines ,etc****************************Lets not forget the lawyer fee.He gets his money up front.I wonder why?????????????????????????????????????????

of course an attorney gets paid up front, just like any other business.

do you think the poster is going to be able to plead her case down to reckless driving or better without an attorney?

At least consult with an attorney and get a professional opinion about your options. throwing yourself on the mercy of the court is for fools since there is no mercy in the court.

I personally would/did hire an attorney. I was more at ease having him handling the situation. Although, I'm not quite sure that a lawyer will make any kind of difference when it comes to sentencing.....and yes, of course the increase in insurance, loss of license, etc.....unless the lawyer finds a loop hole somewhere, he/she probably won't make much of an impact either way.

That the problem with DUI,there are no loopholes left.If you hire a lawyer,there goes your money that you need to pay off all your other fines.

Well.....I don't know about that....


I have 2 friends within the last couple of years who have had lawyers who found so called "loop holes". One could not get a reading on the blow test due to asthma, and the case was dismissed (she got her license back and everything), even though she was obviously drunk and had run her car into a ditch.

that could be,they didnt have any evidence to go on.The lawyer actually did something,but ,the drivers stilled payed his fee.I guess the cop felt he caused a little bit of misery.But, if you cant take the BAT they should have gotten blood to make the case stick.Hard to belive the cops didnt follow thier procedure,maybe thier were drunk too.

Take Stephen's advice only


Get an attorney. Chances are, if it is a first offense you will be able to plead down to reckless driving. This happens most of the time (and all I had to do was sit in traffic court one day to see most of the DWI cases pleaded down to reckless driving). In the future be careful in WHATEVER you take be it xanax, benedryl, anti depressants, or even being tired. ANYTHING that impairs your driving is cause for DWI charge.

I know I am setting myself up for much grief with this next statement and I am not condoning driving while impaired but honestly I would say it is not something that 99% of us hasn't done at one time or another. I know that it is a horrible danger and am in no way defending the poster but everyone makes a mistake. Hopefully now the poster realizes what COULD have happened and is changing her ways. Sometimes it takes a swift kick in the behind to realize reality.

dont worry, i have completely learned my lesson. the hard way. and i'll always be careful what i take from now on when i'm driving. this has just been a nightmare.

looks like i'll be getting a lawyer**************...
