Question

First DUI second Alcohol offense

What is the name of your state? California
First offense: Dmv was told under 21 w/ a BAC above 0.01% 1 yr suspension, CA courts were told open container under 21 no DUI given those were the only charges. Cleared closed, no probation
Second offense: I have a DUI and am over 21, need to work and go to school, is it woth it to fight the DUI with a BAC at 0.08%, and plead Wet & Wreakless? and do a DMV hearing? Was pulled over for not having a third break light!!!

Your attorney is the only person who is in a position to evaluate the strengths of the possible defenses in your case. If you are going to lose at trial, you should take the wet reckless.
