first offence DUI in PA...paging "paguy88" and "FlyingRon" and "kate33"
What is the name of your state? PA arrest and live in OHIO
paging "paguy88" and "FlyingRon" and "kate33"
My wife is a RN licensed in both OHIO and PA, and currently has worked in PA for the last 2 years. Recently she got 2 speeding tickets in the last 6 months due to keeping up with the crazy traffic in PA.
Anyway on 5-12-08 she got pulled over after drinking at an after work function at 1am. She got lost and ran a red light and was pulled over. She failed the sobriety test and blew a .137 into the portable tester. She was then taken to a hospital for a blood draw for an accurate BAC which I don't have the results for yet, but should be more accurate and thus lower.
I already made an appointment with a lawyer from PA, which has handeled these cases, and whos name was given to me buy a good friend. However I would still very much like some input from PAGUY88 and FLYINGRON as I have read some previous posts and you guys seem very knowledgable about the process.
Who knows that the BAC will come up as, but I am thinking Tier 2, and hopefully she will be offered the ARD program. My wife has no prior convictions, no arrestes, and is an outstanding citizen and just made a bad choice.
My main concerns at this point is not the money, but the affect of losing her drivers license and the affect it will have on our insurance rates.
She has an OHIO drivers license and works in PA and that is where she was arrested. When she got her speeding tickets in PA, she didn't get any points on her license because it happend in PA. I did get 1 letter from the OHIO bmv after the 2nd speeding ticket that stated she would not get points in OHIO either, but just informed US the OHIO was notificed of the occurance.
I was reading a similar post by "kate33" being licensed in PA, dui in PA, went into the ARD, and moved to IA.
When my wife was arrested and I picked her up from the police station they said she could take her OHIO license and still drive until the hearing. If she would have gotten a DUI in ohio, they take your license on the spot.
If she gets into ARD, Will they just suspend her PA driving privs and keep her OHIO license? Or will they take her OHIO license too. I know PA and OH are in the drivers license compact or something like that but I don't know what the stipulations are.
2nd question deals with car insurance. I've read some states to reinstate your license if it is taken away you have to pay a premiun insurance rate to get a sr-22 form. My wife wanted to quit the PA job and work in ohio, so I don't care if her driving privs get suspended in PA, but I need her to still have a license in OHIO. According the "kate33" after 60 days she had to pay PA 25 dollars to get her license back, but I dont' know if this resulted in her needing SR-22 insurance.
DOES insurance rates go up if you are in the ARD program?
Please help me out guys,
Sincerely,
Rob O.
