Got A Court Date On Monday...

What is the name of your state (only U.S. law)? CA
Ok got this DUI (which was out of pocket anyway but didn't follow up because I was scared of the reprocussions) but anyway, been going through DEJ over a year year now. Run a home-based business, single mom, have to move because I can't pay rent, going to school full time and now got sent to court again (third time) by my "parole officer" due to abscences because of out-of-state business trips and my daughter was sick. What's going to happen???? Should I get a lawyer? What should I do? I can't really afford one! My daughter needs me here....

You may find yourself going to jail.

You do not get to avoid a court ordered appearance because you have something more important to do.

Get a lawyer. Take care of business.

If you keep flaking, your daughter will be taken by the state when you get sent to jail.

First off, lose your blatantly flippant attitude. You're on probation for committing a criminal offense, and you obviously have no clue what can happen here.

You better start showing more respect for your Probation Officer and lose the quotes. Your Probation Officer is an officer of the Court, and right now is your god. You don't have the luxury of being disrespectful.

The Court doesn't care what you had going on. Appointments with your Probation Officer are the most important thing in your life right now. I realize that you would really love nothing more than to place your daughter in that #1 slot right now, but honestly, she can't make the decision to send you to jail.

From the sounds of it, you're really going to jail for a while. It sounds to me like your Probation Officer has already seen what I just pointed out to you, and simply isn't going to tolerate anymore of it. Your Probation Officer has probably filed a Motion to Impose Sentence and Revoke Probation. Sound familiar? If it does, make arrangements for your daughter BEFORE you go to Court, and don't expect to get to go home. Dress appropriately and leave all jewelry and other items AT HOME.

How is that you didn't get the gist of this at the time you were placed on probation? How old are you?

IF you bring your child to court with you that day expect that the state will remand your child to their custody due to your lack of poor judgment. You will want to make sure that the child is with her father -- preferably -- or with another trusted relative. However if with another trusted relative, the child's father can still get custody if he asks for it and you are sitting in jail. Being irresponsible could cost you your child. Congrats. Time to grow up and start being responsible.
