Got Dui dropped to Wet&Reckless @court, but DMV is coming up HELP!!What is the name of your state (only U.S. law)? CA Thank God for .09 Blood test. So DUI became Wet & Reckless. F**kin CHP over exaggerate the police report and I pass all the test with no mistake, which amazed the DA. Court gave me 12 Hrs. education class, which is ridiculous, nothing but watching movies, no license suspension and 1300 fine. Now DMV hearing is coming up: 1. Is there any luck of lower punishment as well? 2. Do I need a lawyer or they will says what it is and that's it, or can I argue my case at all? Thanks for all comment. |

| You do not "need" an attorney for the DMV hearing. You can argue whatever you want, but the hearing involves very limited issues. Essentially, if the officer had reasonable suspicion to detain you, probable cause to arrest you, and there is good reason to believe you had a BAC of .08 or higher, that's it. Since you had a BAC of .08 or higher, you will suffer some penalty. How long your license will be suspended is a question you can ask the hearing officer. - carl
