I got pulled over for speeding 13 over. I'm 18 and I was with one other friend who is 18. I had one glass of wine an hour before leaving, my friend had more than me. The officer asked us to blow. I blew a .06 and the legal limit is .08. I was given a ticket for driving impaired, an MIP, and a speeding ticket. The speeding ticket I understand. How was I driving impaired if I only blew a .06? can someone explain this? Should I fight it?

By virtue of the MIP you were impaired no matter the reading and one can be impaired without any reading based on your behavior.

How much time elapsed from when you began driving to when your Blood Alcohol Content was tested ? A good expert will "relate back" your BAC to the beginning of the driving and will probably prove up a BAC of about .10% while driving - well over the legal limit.

How well were you driving? What did the cop state in his report regarding your driving, other than the speeding ?

Were FSTs given ? You may believe you did admirably well on FSTs, but they are divided attention tests -- you may have performed them differently than explained and demonstrated...
