grasping at straws


What is the name of your state?
I recently received a dui in PA. I was pulled over for not having my headlights on at 2am. To get to the point I applied for ASP, a second time offenders program. They said i had a point .16 bac within a week from a trial date they said it was a mistake I had a .09. Is this grounds for me trying to fight the case or should i just plead guilty and take my punishment like a man.


To give more detail my first dui was in new jersey 5 years ago. My second in PA with a nj drives liceanse. I now have a PA drivers liceanse. This incident occured 3/06 and my final court date is next monday. I took the breathilizer as well as a blood test.

Any help in this matter would be greatly appreciated

The tone that others take with people asking for advice is disturbing on this board. People are asking for serious advice, not commentary on why they should stop drinking and driving... I'm sure they'll get plenty of that from a judge or prosecutor. For the most part, when a person gets into trouble, they know they made a mistake.

I've seen some folks ask serious questions only to get landblasted... the information I was given on a previous thread was absolutely wrong as confirmed by two top-notch attorneys. I wouldn't give much thought to any advice given here. Just my two cents.

And of course, you didn't see the post from the jerk who came here after THREE DUIs and wanted to find a way to CONTINUE drinking and driving without penalty.

a MISTAKE?? alot that I have read have come back after multiple DUI's APPARENTLY they didn't learn. SIMPLE answer DON'T DRINK AND FREAKIN DRIVE. If you are going to drink STAY AT HOME. If you for some reason feel the need to go out and DRINK have a DESIGNATED DRIVER!! BUT if you feel that ohhhhhhhh I won't get caught and then DO.. TAKE IT LIKE A MAN. DO THE CRIME BE PREPARED TO DO THE TIME. Everyday there are many innocent victims that lose their lives because of your so called STUUUUUUUUPID MISTAKES!! Oh lemme guess.. you would be so so sorry if you took someone elses life for that one lil ole so called mistake. The thought makes me sick to my stomach.

I don't disagree with anything that you said, however, tell me what sense it makes to have a legal advice board where people are asking questions about their case only to get ripped a new one? Maybe there should be another thread / board for people to rip on those whom are posting questions.

Oh, and I'm sorry for mispelling *lambasted*... Folks who've never been caught or made a legal mistake love to rip on folks that have until the shoe's on the other foot. I know for a fact there are people that peruse this board and probably one of you holier than thou lawyer types that *lambast* folks that have been out drinking and driving yet you've done it and just been lucky.

LET ME SAY THIS... I DO NOT CONDONE DRINKING AND DRIVING NOR ANY ILLEGAL ACTIVITY FOR THAT MATTER. I don't condone drugs, not even the occasional dope smoker who "doesn't hurt anyone." At the same time, it seems counter productive to me for a board to be set up that advertises free legal advice only to turn around and rip the person posting for advice. Like I said earlier, most (NOT ALL), who post here I'm sure regret their mistakes. You are right it really doesn't become a mistake in a person's eyes until they are "caught" but that doesn't mean they don't feel true remorse for that mistake.

I'm not meaning to tick anyone off - I'm just giving my take on things here. Surely I'm not the only one to ever feel this way.

I almost lost my dinner on that one laughing so hard. Son, if you only did half the things I've done, some even in the name of the good ol' U.S. of A, you'd shrink like a school girl losing her virginity.

No one is perfect. and I sure as hell don't want to be the next on the cross. But the difference is you don't seem to 'get it' and expect others to care. Well, I will care about you the same as you care about my daughters when you get drunk or even impaired and get behind the wheel of a dangerous weapon...and that is not one bit.

Well, first off - I'm not your son. And second, I've served my country for five years, so don't talk to me about "shrinking like a school girl..." Which is a pretty poor analogy.

My question was never really answered - what sense does it make to have this board set up only to rip on others? And by the way, I do "get it."

I will leave it at this... I respect your stance, but I don't agree this is the forum to act on it.

Geez some compulsive drinker comes here wanting free advice then complains about it! First off if you had not drank and drove you would have no need for this site! People with several DUI's send red flags of alcoholism. How do I know simple I am one! I am a recovering alcoholic of over 20 years was arrest for DUI five times (convicted four) had numerous accidents as a result of my insane behaviors nealry lost one of my eyes as a result! Walked the streets with crap in my pants and the list goes on! If I had listen to the "honest" people who told me exactly what I was and what was wrong with me I might have saved myself alot of misery jail time etc! Dont come here crying poor me! You r a lethal weapon everytime you drink and drive! I for one dont want my children indangered by this insanity of drinking and driving! You dont like that well too bad read my signature line it applies to your very complaint!

Rant over I am now getting off my soap box!

I wish they had done that many a year ago when I was still drinking one of my accidents was in a Toyota on that day my BAC was .39 If they had that in place then I would had never drove that day. On that day I rolled my toyota pick up in Brea Cayone and was tossed from truck with broken ribs. Good thing I was tossed truck looked like an accordian

boomer, you're right. Someone like BelizeBreeze only shows up to give insults. BelizeBreeze has yet to offer even a bit of legal advice. There are several teetotalers who continue to show up and offer their "advice." It's been going on for years.
