HELP!!! 1st offense DUI, caught w/o driving, lawyer irresponsible...


What is the name of your state (only U.S. law)? CA
21+ , 0.24% BAC 1st offense, I was arrested at someones house when the person who lives there called the police because i was drunk in public and knocked on their door at 3am. My car was parked on the porch across the street from where I was...Blacked out that night , dont remember anything. Hired a lawyer who is probably the worst lawyer on the planet, never picks up the call, doesnt return my call no matter how many voice mails i leave. basically not even try to help at all. Tried to have someone who was there that night to be the witness as the driver who drove me there that night, turned out flake and fked me over because the DA sent investigator who never able to contact him. Now I'm having my court date this week. And don't know what I should do, should I give up? It's been over 6 months, and I'm a college student don't have more money to hire a better lawyer =/

You were driving with a 0.24% BAC and blacked out and you don't remember? Yet you say you remember someone else was driving but THAT MYSTERY PERSON flaked out AND your LAWYER is irresponsible?
How did they determine you were in the car? You parked on the porch across the street? I bet there were witnesses who saw you behind the wheel. What do you expect everyone else to do? You need to quit drinking and realize that you are most likely going to be doing some time. And lose your license. And have to do alcohol classes.

Classis mistake of the unititated - thinking that their attorney has something to do on their case each and every day. You DO realize that there may only be two or three hearings before a trial (which could take months to occur), right? What, exactly, do you think he can do in all that time in between? If you were really paying him for all that time, you'd have to sell the house ... and your parents' house ... etc. In most phases of a trial, there really is very little he can do. And most attiorneys do not appreciate being hounded by clients that they have already told, 'I'll let you know when I find out something..." (or something like that).

Let me guess ... you don't know the driver, never met him before, he's a white or Hispanic guy of medium height and build, with light or dark hair.

Maybe your friend decided he was not going to lie for you? I mean, if you had blacked out all night, how do you know you did not drive the car?

It's not so much a problem with your lawyer as it is probably a problem with your case. You have a weak or nonexistent defense ... so, what is it that you hope this attorney can do for you that he has not been doing?

I once had a SOBER kid park on the sidewalk in front of the front doors to a liquor store. You had to squeeze around his Toyota to get in to the store. His reason: "There wasn't a sign saying i couldn't."

Needless to say he got hit for two moving violations and two municipal code violations.
