Help


What is the name of your state?California.
I was arrested for a drunk in public recently by a chp. My boyfriend and I were on our way to the city (S.F.) to do some work, I had 2 glasses of wine at lunch yet I was very upset about a personal matter, we were arguing and I decided I did not want to go to S.F. and I said I would jump out of the car if he didn't stop. He (my boyfriend) took the next exit which was right before the Golden Gate Bridge. He thought I would jump out of the car wich I motioned to do, so he pulled my hair. I was already upset so I started crying.
we happened to pull over next to a CHP long story short she had me exit the vehicle at which time she arrested me for drunk in public. Which I was not drunk just upset. Anyway, the DA offered me diversion which I wanted to take however my Public Defender said I had a good case. So now it is going to trial am I in big trouble? What should I do?

Lucky for your boyfriend that he didn't get arrested for battery.

Diversion was a good deal.

And you may not have been "drunk", but that definition is very subjective. And all that is required for the charge is that you were iunder the influence of drugs or alcohol, and were demonstrating your inability to care for your own safety or the safety of others.

Your defense attorney may argue that you were defending yourself against an assault by your boyfriend. Your defense might be that you were the victimt of an assault.

You might want to ask your attorney if he intends to throw your boyfriend to the wolves to defend yourself.
