How long to wait--PA


What is the name of your state? PA
On Nov 11th I was getting onto I-476 and I hit a construction vehicle. I had been out and had 3 drinks. I took a breathalizer test at the accident site. I had to blow twice because I was crying and wasn't able to do it on the first try. I do not remember what he said the number was because I was pretty hysterical, but I do not think I passed it. I was taken by the state police to the hospital and treated for a broken foot. They did draw blood while I was at the hospital. My parents came and got me from the hospital. I was never taken to the station or formally charged with drunk driving. When we were leaving the hospital the Trooper said I will get something in the mail about having a hearing. It has been almost 3 weeks since the accident and I haven't received or heard anything. Should I contact the state police about this or just keep waiting? What could be the hold up? Also, if I did fail the breathalizer, I know my license will be suspended. I also know that there could be license suspension for hitting the construction vehicle. Because I broke my foot, I have not been able to drive since the accident. Is it possible that I might be able to count the days that I haven't been able to drive towards the number of days my license may be suspended?

they'll find you,they're probably backed up. it took about a month to get my stuff in the mail. now its time to do a little research..if this is your first offense you could be eligible for the ARD program,but since you were in an accident you might not be eligible. what was your BAC?

I don't believe the time you've been physically unable to drive will count in your suspension. In fact, the court side and DMV side are two different things, the longer of the two prevailing as to when the suspension ends.

I do not know my BAC. I went back to the hospital that i was treated at and they said they didn't do any blood work. They drew blood that night because i came in as an accident with a broken foot and it is standard procedure to to draw blood but 'if nothing else is going on they don't do anything with the blood' (that's what the nurse told me). So the only thing they can go by is the breathalizer numbers, (which, like I said, I don't remember because I was crying so much).

Do I have a chance at ARD??


So , I got the affadavit in the mail. My breathalizer result was .230 and they have my blood but I didn't get the results of that yet. Being that my number is so high and I was in an accident, what are the chances of getting into ARD in Montgomery County in PA?? It is my first offence and I have a TOTALLY clean record. My lawyer suggested I go to counseling and get people to write some character letters for me to help my chances, all of which I am going to do. I am scared that I am going to get denied and go to jail. Do I have hope?

since you didn't injure anybody or kill anyone,you are still eligible. since your BAC was that high i can guarantee you'll have to do addtional counseling.
